This Agreement governs the relationship between Servicio de Taxi Express LLC (“STE”, “Platform”, “we”) and you (“Driver”, “you”) when registering and operating as an independent driver on the Taxi Express app.
Article 1. Definitions
Terms defined in the Terms of Service apply here. “Settlement” means weekly ACH payment of net accumulated earnings.
Article 2. Independent contractor relationship
2.1. You act as an independent contractor, not as an employee, agent, partner, or legal representative of STE.
2.2. You control when to go online, which Rides to accept, and routing, within law and App policies.
2.3. No employment relationship exists; you are responsible for your own federal and state taxes (Form 1099 when applicable).
2.4. You are not entitled to employee benefits (vacation, health insurance, workers’ compensation from STE).
Article 3. Legal requirements in Georgia
You represent and warrant ongoing compliance with:
- Minimum age of 18 years.
- Valid driver’s license issued by the Georgia Department of Driver Services (DDS).
- Vehicle registered, insured, and fit for passenger transport in Georgia.
- O.C.G.A. § 40-5-39 and applicable transportation rules in Georgia and local jurisdictions.
- For-Hire endorsement or equivalent documentation when required by law.
- Background screening per FCRA and STE/Checkr processes.
Article 4. Registration, documentation, and approval
4.1. You must complete the in-App form, upload truthful documents, and provide ACH bank details.
4.2. Required documents: DDS license, liability insurance, vehicle registration, background certificate or For-Hire endorsement, and others STE may request.
4.3. STE will manually review your application and may approve, reject, or request additional information.
4.4. False information is grounds for immediate termination and possible legal action.
Article 5. Background checks (Checkr / FCRA)
5.1. You authorize STE to obtain consumer reports under the FCRA, directly or through Checkr, Inc.
5.2. STE may submit your information to Checkr manually; you agree to receive a copy of the report and adverse action notice if required by law.
5.3. An adverse result may prevent activation or cause account deactivation.
Article 6. Fares, commission, and passenger payments
6.1. Fares are calculated in the App and shown to the Passenger before the Ride.
6.2. Passenger payments may be processed by card via Stripe or by cash directly between Passenger and Driver when selected in the App.
6.3. STE retains a platform commission on the Ride fare (excluding taxes collected from the Passenger).
6.4. Sales and transportation taxes are calculated and withheld per Georgia law.
Article 7. ACH settlements to Driver
7.1. STE settles net accumulated earnings via weekly ACH transfer (Fridays) to your registered bank account.
7.2. You must keep accurate bank details; STE is not responsible for delays due to incorrect information.
7.3. STE may withhold amounts for charge disputes, proven fraud, or pending breach investigations.
Article 8. Insurance and vehicle liability
8.1. You must maintain valid liability insurance covering passenger transport as required by Georgia law.
8.2. You are solely responsible for accidents, fines, third-party damage, and injuries during transport, except direct fault of STE in Platform operation.
8.3. You must notify STE of license suspension, expired insurance, or vehicle change before operating.
Article 9. Conduct and quality standards
- Treat Passengers with respect; zero tolerance for harassment or discrimination.
- Keep vehicle clean, safe, and mechanically adequate.
- Comply with Georgia traffic laws and local ordinances.
- Do not solicit off-App payments or circumvent STE commissions.
- Maintain minimum rating required by STE (if applicable).
Article 10. Equipment and App use
10.1. You must maintain a compatible smartphone with GPS and active mobile data while online.
10.2. You must allow real-time location data and background location while operating on the App for dispatch and safety. See our Location Data Disclosure.
10.3. You may not share your account or allow third parties to drive under your profile.
Article 11. Intellectual property and brand
You may use STE brand materials only to operate on the Platform. You may not use the brand for competing services without written authorization.
Article 12. Personal data
Data processing is governed by the Privacy Policy. You consent to use of location and documents for verification and operations.
Article 13. Termination
13.1. Either party may terminate by closing the account.
13.2. STE may deactivate access immediately for breach, serious complaints, fraud, adverse background result, or safety risk.
13.3. After termination, you must cease representing yourself as an STE Driver and settle outstanding obligations.
Article 14. Indemnification
You will indemnify Servicio de Taxi Express LLC against third-party claims (including Passengers) arising from your driving, breach of this Agreement, or violation of law, except sole fault of STE.
Article 15. Limitation of liability
STE’s liability to the Driver is limited to unpaid net earnings from disputed Rides in the prior thirty (30) days, unless mandatory law requires otherwise. STE is not liable for Driver lost profits.
Article 16. Governing law and jurisdiction
This Agreement is governed by the laws of the State of Georgia. Disputes are resolved in courts of Hall County, Georgia, with waiver of forum non conveniens to the extent permitted.
Article 17. Modifications
STE may modify this Agreement by posting the current version at /legal/driver-agreement.html. Continued operation implies acceptance.

El presente Acuerdo («Acuerdo») rige la relación entre Servicio de Taxi Express LLC («STE», «Plataforma», «nosotros») y usted («Conductor», «usted») al registrarse y operar como conductor independiente en la aplicación Taxi Express.
Artículo 1. Definiciones
Los términos definidos en los Términos de Servicio aplican mutatis mutandis. «Liquidación» significa el pago semanal ACH de ganancias netas acumuladas.
Artículo 2. Relación de contratista independiente
2.1. Usted actúa como contratista independiente, no como empleado, agente, socio ni representante legal de STE.
2.2. Usted controla cuándo conectarse, qué Viajes aceptar y la ruta, dentro de la ley y las políticas de la App.
2.3. No existe relación laboral; usted es responsable de sus propios impuestos federales y estatales (Formulario 1099 cuando corresponda).
2.4. No tiene derecho a beneficios de empleado (vacaciones, seguro médico, compensación laboral de STE).
Artículo 3. Requisitos legales en Georgia
Usted declara y garantiza cumplir en todo momento:
- Edad mínima de 18 años.
- Licencia de conducir válida emitida por el Georgia Department of Driver Services (DDS).
- Vehículo registrado, asegurado y apto para transporte de pasajeros en Georgia.
- Cumplimiento de O.C.G.A. § 40-5-39 y normas aplicables de transporte en Georgia.
- Endoso For-Hire o documentación equivalente cuando la ley lo exija.
- Verificación de antecedentes conforme a la FCRA y procesos de STE/Checkr.
Artículo 4. Registro, documentación y aprobación
4.1. Debe completar el formulario en la App, subir documentos verídicos y proporcionar datos bancarios ACH.
4.2. Documentos requeridos: licencia DDS, seguro de responsabilidad civil, registro del vehículo, certificado de antecedentes o endoso For-Hire, y demás que STE solicite.
4.3. STE revisará su solicitud manualmente y podrá aprobar, rechazar o solicitar información adicional.
4.4. Proporcionar información falsa es causa de terminación inmediata y posibles acciones legales.
Artículo 5. Verificación de antecedentes (Checkr / FCRA)
5.1. Usted autoriza a STE a obtener reportes de consumo conforme a la FCRA, directamente o mediante Checkr, Inc.
5.2. STE puede someter su información a Checkr manualmente; usted acepta recibir copia del reporte y notificación de acciones adversas si la ley lo exige.
5.3. Un resultado adverso puede impedir la activación o causar desactivación de su cuenta.
Artículo 6. Tarifas, comisión y pagos al Pasajero
6.1. Las Tarifas se calculan en la App y se muestran al Pasajero antes del Viaje.
6.2. Los pagos del Pasajero pueden procesarse con tarjeta vía Stripe o en efectivo directamente entre Pasajero y Conductor cuando se seleccione en la App.
6.3. STE retiene una comisión de plataforma sobre la tarifa del Viaje (excluyendo impuestos cobrados al Pasajero).
6.4. Impuestos sobre ventas y de transporte se calculan y retienen conforme a la ley de Georgia.
Artículo 7. Liquidaciones ACH al Conductor
7.1. STE liquida ganancias netas acumuladas mediante transferencia ACH semanal (viernes) a la cuenta bancaria registrada.
7.2. Debe mantener datos bancarios exactos; STE no es responsable por retrasos por información errónea.
7.3. STE puede retener montos por disputas de cargo, fraude comprobado o incumplimiento pendiente de investigación.
Artículo 8. Seguro y responsabilidad del vehículo
8.1. Usted debe mantener seguro de responsabilidad civil vigente que cubra transporte de pasajeros según exija la ley de Georgia.
8.2. Usted es único responsable de accidentes, multas, daños a terceros y lesiones ocurridos durante el transporte.
8.3. Debe notificar a STE de cualquier suspensión de licencia, seguro vencido o cambio de vehículo antes de operar.
Artículo 9. Estándares de conducta y calidad
- Tratar Pasajeros con respeto; cero tolerancia a acoso o discriminación.
- Vehículo limpio, seguro y en condiciones mecánicas adecuadas.
- Cumplir leyes de tránsito del Estado de Georgia y ordenanzas locales.
- No solicitar pagos fuera de la App ni eludir comisiones de STE.
- Mantener calificación mínima exigida por STE (si aplica).
Artículo 10. Equipamiento y uso de la App
10.1. Debe mantener un smartphone compatible con GPS y datos móviles activos mientras esté en línea.
10.2. Debe permitir ubicación en tiempo real y ubicación en segundo plano mientras opera en la App. Véase la divulgación de datos de ubicación.
10.3. No puede compartir su cuenta ni permitir que terceros conduzcan bajo su perfil.
Artículo 11. Propiedad intelectual y marca
Puede usar materiales de marca STE solo para operar en la Plataforma. No puede usar la marca para servicios competidores sin autorización escrita.
Artículo 12. Datos personales
El tratamiento de datos se rige por la Política de Privacidad. Usted consiente el uso de ubicación y documentos para verificación y operación.
Artículo 13. Terminación
13.1. Cualquier parte puede terminar este Acuerdo cerrando la cuenta.
13.2. STE puede desactivar su acceso inmediatamente por incumplimiento, quejas graves, fraude, resultado adverso de antecedentes o riesgo de seguridad.
13.3. Tras la terminación, debe cesar de representarse como Conductor de STE y liquidar obligaciones pendientes.
Artículo 14. Indemnización
Usted indemnizará a Servicio de Taxi Express LLC frente a reclamaciones de terceros derivadas de su conducción, incumplimiento de este Acuerdo o violación de ley, salvo culpa exclusiva de STE.
Artículo 15. Limitación de responsabilidad
La responsabilidad de STE frente al Conductor se limita a las ganancias netas no pagadas de Viajes disputados en los últimos treinta (30) días, salvo mandato legal imperativo.
Artículo 16. Ley aplicable y jurisdicción
Este Acuerdo se rige por las leyes del Estado de Georgia. Las disputas se resolverán en tribunales del Condado de Hall, Georgia.
Artículo 17. Modificaciones
STE puede modificar este Acuerdo publicando la versión vigente en /legal/driver-agreement.html. La operación continuada implica aceptación.
